Please read these terms before purchasing a report. By completing a purchase you agree to them.
1. About this agreement
These terms govern your use of SmartCarCheck at smartcarcheck.co.uk (“the Service”). By accessing the Service or purchasing a report you agree to these terms. If you do not agree, do not use the Service.
2. The Service
SmartCarCheck provides AI-powered buyer reports for UK-registered vehicles. Reports draw on data from the DVSA MOT History API and DVLA Vehicle Enquiry Service API and are supplemented by AI analysis.
The report is a decision-support tool. It is not a guarantee of a vehicle's condition, roadworthiness, provenance, or value. We are not mechanics, surveyors, or financial advisers. Professional inspection before purchase is always recommended.
3. Eligibility
You must be at least 18 years old and resident in the United Kingdom to purchase a report. By placing an order you confirm you meet these requirements.
4. Pricing and payment
Reports are priced at £9.99 per report (introductory price; standard price £14.99). All prices include VAT where applicable. Payment is a one-time charge — there is no subscription.
Payments are processed by Stripe. By submitting payment you also agree to Stripe's Terms of Service. We do not store card details.
5. Refunds
Because reports are generated and delivered instantly, we do not offer refunds for a change of mind or accidental duplicate purchases.
If a fault on our side means your report was incomplete, inaccurate due to a data retrieval error, or not delivered, you are entitled to a full refund or a free regenerated report (your choice). Refund requests must be raised within 14 days of purchase by emailing billing@smartcarcheck.co.uk with your registration number and order details.
6. Accuracy of data
MOT history and registration data are sourced directly from DVSA and DVLA APIs. We reproduce this data as provided and are not responsible for errors or omissions in the source data. If you believe government records are incorrect, the appropriate remedy is to contact DVSA or DVLA directly.
AI-generated analysis, verdicts, and negotiation suggestions are generated programmatically and should be treated as guidance only. They do not constitute professional mechanical or financial advice.
7. Intellectual property
Reports are licensed to you for personal, non-commercial use only. You may not reproduce, redistribute, or sell report content. The SmartCarCheck brand, Website design, and AI analysis methodology are our intellectual property.
8. Limitation of liability
To the maximum extent permitted by law, SmartCarCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or any financial loss arising from a vehicle purchase decision made in reliance on a report.
Our total aggregate liability to you for any claim related to a report shall not exceed the amount paid for that report (i.e. £9.99 or the then-current purchase price).
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
9. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to scrape, reverse-engineer, or automate requests to the Service.
- Misrepresent report content to third parties.
- Resell or commercially distribute reports.
10. Changes to the Service and these terms
We reserve the right to modify or discontinue the Service (or any part of it) at any time. We will update the “Last updated” date when these terms change. Continued use after a change constitutes acceptance of the revised terms.
11. Governing law and disputes
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
